Local laws

Mount Alexander Shire Council has introduced Local Laws aimed at ensuring the amenity of the area. Contact us to get in touch with our Local Laws Department with regards to complaints or queries relating to:

Local Law No 1 of 2008 – Meeting Procedures

Purpose

The objectives of this Local Law are to:

Regulate and control the procedures governing the conduct of meetings of the Council and of the special committees appointed by the council;

Note Council’s Local Law Procedure Manual makes provision in respect to the applying of the Common Seal, which should be read in conjunction with this Local Law.

Local Laws Procedure Manual

Purpose and use
This Procedure Manual is to be used in conjunction with the Councils Local Laws 2,3,4,5 & 6. The manual provides additional information to complement the general details in each of the Local Laws.

Local Law 2 - Roads and Council Land

Purpose
1) managing the uses and activities on roads and Council land so that the Council is aware of uses or activities which may:
(a) interfere with the safety and convenience of people travelling on or using roads or land;
(b) impede free and safe access for people, in particular those with sight and movement impairment or disabilities;
(c) cause damage to Council and community assets;
(d) create a danger or expose others to risk; or
(e) be detrimental to the amenity of the area or the enjoyment of facilities on roads or land;

Local Law 3 - Environment

Purpose
The purpose of this Local Law is to provide for the peace order and good governance of the Mount Alexander Shire by:
(1) managing activities and uses which may be dangerous, cause damage or a nuisance or be detrimental to the amenity of the area or the environment;
(2) regulating and controlling activities to maintain a healthy and safe environment in the municipal district for residents and visitors;
(3) identifying requirements or conditions that must be observed to ensure that a safe, healthy and enjoyable environment for residents and visitors is maintained; and
(4) providing for the administration of the Council’s powers and functions.

Local Law 4 - Animals

Purpose
The purpose of this Local Law is to provide for the peace order and good governance of the Mount Alexander Shire by:
1) managing activities and uses which may be dangerous, cause a nuisance or be detrimental to the amenity of the area or the environment;
(2) regulating and controlling activities to maintain a healthy and safe environment in the municipal district for residents and visitors;
(3) regulating the manner in which animals are kept and housed and the number of certain animals that may be kept on a property; and
(4) providing for the administration of the Council’s powers and functions.

Local Law 5 - Trading

Purpose
The purpose of this Local Law is to provide for the peace order and good governance of the Mount Alexander Shire by:
(1) managing the uses and activities on roads and Council land so that the Council is aware of uses or activities which may:
(a) interfere with the safety and convenience of people travelling on or using roads or land;
(b) impede free and safe access for people, in particular those with sight and movement impairment or disabilities;
(c) create a danger or expose others to risk; or
(d) be detrimental to the amenity of the area or the enjoyment of facilities on roads or land.

Quick guide to footpath trading

A guide to footpath trading is now available to provide local businesses with advice on how to make their business more accessible for trading.

Council is reminding local businesses about the permit renewal process for footpath trading and outdoor eating, in accordance with Council’s Local Law No 5 – Trading. This may include the display of signage, goods or tables and chairs for outdoor dining.

The best practice information in the Quick Guide is not mandatory in Mount Alexander Shire. However, traders must ensure that they are compliant with the requirements of the Local Law No. 5 – Trading, which includes a requirement to maintain a 1.8m clearance in a straight line along the footpath. Local Law 6 - Fundraising and Events

Purpose
The purpose of this Local Law is to provide for the peace order and good governance of the Mount Alexander Shire by:
(1) managing the uses and activities on roads and Council land so that the Council is aware of uses or activities which may:
(a) interfere with the safety and convenience of people travelling on or using roads or land;
(b) impede free and safe access for people, in particular those with sight and movement impairment or disabilities;
(c) be detrimental to the amenity of the area or the enjoyment of facilities on roads or land;

Parking Restrictions in Mount Alexander Shire


Parking and traffic laws apply to ensure the safe and fair use of Victoria's roads. Specific parking restrictions and the council’s parking permit system help make parking available for both residents and visitors.  If you park illegally in the Mount Alexander Shire, you risk being fined. If you do not pay the fine, additional costs will be added.  Parking infringement notices are necessary to regulate and control the use of parking spaces throughout the Mount Alexander Shire.
 
Failure to pay a parking infringement notice or to take any other action within 28 days may result in further enforcement action and the incurring of further costs.
